At Liberance Abogados (“Liberance”, “we”, “us” or “our”) we are committed to protecting your privacy. This Privacy Policy explains what personal data we collect when you visit this website or contact us, why we use it, the legal bases for doing so, who we share it with, and the rights you have. We handle personal data in accordance with Argentina’s Personal Data Protection Law No. 25.326 and, where it applies to you, the EU General Data Protection Regulation (Regulation (EU) 2016/679, “GDPR”) and the ePrivacy Directive 2002/58/EC.
1. Who is responsible for your data
The data controller is Liberance Abogados, a law firm based in Buenos Aires, Argentina, providing legal and strategic advisory in cross-border matters between Latin America and Europe.
- Email: info@liberance.com.ar
- Registered name and address: [to be completed — razón social y domicilio legal del responsable]
- Phone: [+54 …]
For any question about this policy or about how we process your data, you can contact us at the email above. If you are in the EU/EEA and would like to reach us about data protection specifically, please use the same address and mark your message “Data protection”.
2. What personal data we collect
We only collect the data we need, and most of it is data you choose to give us.
- Data you provide through our contact form: your name, email address, the subject and content of your message, and any other details you choose to include (for example, a phone number).
- Data you send us by email: any personal data contained in messages you send to info@liberance.com.ar.
- Technical and usage data: limited information collected automatically, such as your IP address, device and browser type, and pages viewed. Some of this is processed by our hosting provider for security and reliability, and — only if you consent — by our analytics provider (see section 5).
We do not knowingly collect special categories of data through this website, and we ask you not to send sensitive information through the contact form.
Is providing your data mandatory? Providing your data is voluntary. The contact-form fields marked as required (name, email and message) are needed for us to respond to your enquiry; if you do not provide them, we will not be able to reply. If we go on to act for you, some data may be required to perform our engagement or to meet our legal and professional obligations, and not providing it may prevent us from acting for you.
3. Why we use your data and our legal bases
We use your personal data for the purposes below. Under the GDPR, each purpose relies on one of these legal bases:
- To respond to your enquiry and follow up — legal basis: the steps taken at your request prior to a possible engagement (Art. 6(1)(b) GDPR) and our legitimate interest in responding to messages you send us (Art. 6(1)(f) GDPR).
- To assess and provide legal services — legal basis: performance of a contract or pre-contractual steps (Art. 6(1)(b) GDPR).
- To keep the website secure and working correctly — legal basis: our legitimate interest in protecting the site and its visitors (Art. 6(1)(f) GDPR).
- To measure and improve the site with analytics — legal basis: your consent (Art. 6(1)(a) GDPR and Art. 5(3) ePrivacy Directive). Analytics cookies are not set unless you allow them.
- To meet our legal, regulatory and professional obligations — legal basis: compliance with a legal obligation (Art. 6(1)(c) GDPR).
Where we rely on our legitimate interests, we have assessed that the processing is necessary and does not override your interests, rights and freedoms, and you can object to it at any time (see section 9).
We do not sell your personal data and we do not use it for automated decision-making or profiling that produces legal or similarly significant effects.
4. Cookies and similar technologies
This website uses strictly necessary cookies and, with your consent, analytics cookies. You can accept, reject or change your choices at any time through our cookie banner or the link in the footer. Full details are in our Cookie Policy.
5. Who we share your data with
We do not sell or rent your data. We share it only with trusted service providers (“processors”) that help us run this website and respond to you, and only as needed:
- Contact-form provider (Web3Forms): when you submit the contact form, the information is transmitted through Web3Forms, which delivers it to us by email. They process the data on our behalf under their terms and privacy policy.
- Analytics (Google Analytics 4, Google Ireland Ltd. / Google LLC): only if you consent, Google processes usage data to provide aggregated statistics. We enable IP anonymisation and Google’s consent-mode signals.
- Hosting provider: our website host stores and serves the site and keeps security logs. [to be completed — proveedor de hosting].
- Legal and professional advisers and authorities: where we are required to disclose data to comply with the law or to establish, exercise or defend legal claims.
6. International data transfers
We are based in Argentina. Argentina has been recognised by the European Commission as providing an adequate level of data protection (Commission Decision 2003/490/EC), so personal data can be transferred from the EU/EEA to us in Argentina without additional safeguards.
Some of our processors (for example Web3Forms and Google) may process data outside Argentina and the EU/EEA, including in the United States. Where that happens, the transfer is protected by appropriate safeguards: Google participates in the EU–US Data Privacy Framework and also offers the European Commission’s Standard Contractual Clauses, and our other providers rely on Standard Contractual Clauses or equivalent safeguards as set out in their terms.
7. How long we keep your data
We keep your personal data only for as long as necessary for the purposes described above: enquiry and contact data is kept while we handle your request and for a reasonable period afterwards, and longer where we enter into a professional engagement or where the law requires it. Analytics data is retained for the period configured in our analytics tool. When data is no longer needed, we delete or anonymise it securely.
8. How we protect your data
We apply appropriate technical and organisational measures — including encrypted connections (HTTPS) and access controls — to protect your personal data against unauthorised access, loss, alteration or disclosure. No transmission over the internet can be guaranteed to be completely secure, but we work to safeguard the information you entrust to us.
9. Your rights
Subject to applicable law, you have the right to:
- Access the personal data we hold about you and obtain a copy.
- Rectify inaccurate or incomplete data.
- Erase your data (“right to be forgotten”), where applicable.
- Restrict our processing of your data in certain circumstances (Art. 18 GDPR).
- Object to processing carried out on the basis of our legitimate interests (Art. 21 GDPR).
- Data portability — receive your data in a structured, commonly used format.
- Withdraw your consent at any time, without affecting the lawfulness of processing carried out before withdrawal.
- Not be subject to a decision based solely on automated processing that produces legal or similarly significant effects — we do not carry out such processing.
Under Argentina’s Law No. 25.326 you also have the right of access to your data (which you may exercise free of charge at intervals of not less than six months) and the right to the rectification, updating and suppression of your data.
To exercise any of these rights, write to us at info@liberance.com.ar. We will respond within the timeframes set by applicable law.
You also have the right to lodge a complaint. In Argentina, the supervisory authority is the Agencia de Acceso a la Información Pública (AAIP). In the EU/EEA, you may complain to your local data protection supervisory authority.
10. Children
This website is intended for a professional, adult audience. We do not knowingly collect personal data from children. If you believe a child has provided us with data, please contact us so we can delete it.
11. Changes to this policy
We may update this Privacy Policy to reflect changes in our practices or in applicable law. The current version is always available on this page, with the date of the latest update shown above.
